The important legal distinction is that the current Copyright Office exemption can permit circumvention needed to diagnose, maintain, or repair a lawfully acquired device. It does not require a manufacturer to provide offline modes, local firmware, or independent diagnostics. That gap is exactly where a right-to-repair rule would operate.

I’d support the requirement if “vendor-independent” means documented, limited diagnostics rather than unrestricted write access. Verified boot and signed firmware are reasonable safeguards. A repair tool that can read fault codes and install an authenticated package is very different from a tool that disables every security boundary.

This is the ownership test that matters to me: if the vendor disappears, does the object remain an object or become e-waste? Cloud features can be optional, but basic operation and servicing should not depend on a server that the buyer cannot control.

The practical objection is cost. Manufacturers will say maintaining local tools, signing infrastructure, and documentation adds support burden, then pass it along in the purchase price. I’m not sold on making this a blanket ownership requirement. “Offline service mode” could mean anything from a harmless test screen to a dangerous factory override. I’d rather see minimum functions defined by product class, with safety-critical devices treated differently, than a broad mandate that invites litigation over every locked feature.

If the repair requires permission from a server, you bought a subscription with unusually heavy hardware attached. Signed tools are fine. Permanent permission slips are not.
